Welcome to Stevie G's Popcorn Fundraiser! These Terms and Conditions ("Terms") apply to your use of the Stevie G's platform, which includes our website at steviegspopcorn.com and our mobile app. By using the platform, you agree to these Terms and enter into a legal agreement with GStrasse LLC, a Nevada limited liability company ("Stevie G's," "we," "us," or "our").
BY CREATING AN ACCOUNT OR USING OUR PLATFORM, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO THESE TERMS. IF YOU DO NOT AGREE, PLEASE DO NOT USE OUR PLATFORM.
1. Definitions
Here are the key terms used throughout this document:
- "Fundraiser" means a single fundraising event created on our platform by a Team Leader.
- "Team Leader" means the person who creates and manages a Fundraiser.
- "Team Member" means a seller who joins a Fundraiser using an invite code.
- "Shopper" means any person who purchases popcorn through a Fundraiser.
- "Payout" means the share of the product purchase price (excluding taxes and shipping) earned by the Fundraiser, calculated using the tiered Payout schedule set out in Section 6, and paid to the organization if it has its own federal tax ID (EIN), or otherwise to the Team Leader under the Organizer Promise.
- "Platform" means the Stevie G's website, mobile app, and all related services.
- "User" means any person who accesses or uses the Platform.
2. About Our Service
Stevie G's Popcorn Fundraiser is a mobile fundraising platform that lets organizations earn money by selling gourmet popcorn. Team Leaders create Fundraisers, Team Members share their personal invite links, and Shoppers purchase popcorn online. The organization earns a share of every sale on a tiered schedule: 40% from the very first bag, rising in steps to 55% on bags 1,000 and up, as set out in Section 6.
Stevie G's is a technology platform only. We are not a bank, payment processor, or financial advisor. We do not solicit donations.
How payments work. Buyers pay GStrasse LLC for popcorn that we sell. The commission we pay, to the organization or to its Team Leader under the Organizer Promise, is our own money, paid from our own account after the Fundraiser ends. We do not receive, hold or send money on anyone else's behalf.
GStrasse LLC is not a money transmitter. Under federal law, a business that accepts and transmits funds only as part of selling its own goods is not a money transmitter (31 C.F.R. § 1010.100(ff)(5)(ii)(F)). Under Nevada law, we do not receive money for transmission (NRS 671.013); we receive payment for our own products.
We may suspend, limit, or terminate any account at any time if we believe a User has violated these Terms or engaged in fraudulent activity.
3. Who Can Use the Platform
You must be at least 18 years old to create a Team Leader account.
Minors under 18 may participate as Team Members only through a parent or legal guardian. The parent or guardian creates and controls the account, agrees to these Terms on the child's behalf, and enters the child's name and age themselves. A Team Member under 18 never has an account, an email address, or any other sign-in credential with us.
4. Team Leader Responsibilities
As a Team Leader, you agree to:
- Provide accurate and truthful information about your Fundraiser.
- Use Fundraiser funds only for the stated purpose.
- Complete identity verification before receiving any Payout.
- Provide valid payment information for electronic Payout.
- Keep Team Member contact information confidential.
- Comply with all applicable laws, including tax reporting obligations.
- Not use the platform for any illegal or prohibited purpose.
- Give us the assurances we require whenever you act on behalf of someone else, including accepting the Organizer Promise when your group does not have its own federal tax ID number (EIN), and keep every assurance you give.
5. Identity Verification (KYC)
a. Why We Verify Your Identity
To comply with applicable laws and financial regulations - including Know Your Customer (KYC) and Anti-Money Laundering (AML) requirements - Stevie G's requires all Team Leaders to verify their identity before receiving any Payout.
b. What Is Required
- Your legal name, date of birth, and address, and the other details our payment processor, Stripe, asks for when you set up payouts.
- A government-issued photo ID, only if Stripe cannot verify your identity automatically from those details. Most Team Leaders are never asked for one.
c. How It Works
Verification is handled automatically by our third-party partner and takes less than two minutes. Stevie G's does not store copies of your government ID.
d. One-Time Requirement
Verification is required only once. Once completed, you will not need to repeat the process for future Fundraisers. We added these steps to make sure we protect everyone from fraud and abuse.
e. Consequences of Non-Verification
If you do not complete identity verification, Stevie G's will withhold your Payout. If verification cannot be completed, we will hold the Payout and, if it is never claimed, handle it as required by Nevada law.
f. Right to Reject
Stevie G's reserves the right to reject or suspend any Team Leader account if verification fails or if fraudulent documents are submitted.
6. Payouts
After a Fundraiser ends, we pay a Payout calculated from the number of bags sold in that Fundraiser, excluding taxes and shipping. It is paid to the organization if it has its own federal tax ID (EIN), or otherwise to the Team Leader under the Organizer Promise. The rate is tiered and applies in bands, so each rate below applies only to the bags sold within its own band:
- Bags 1 to 299: 40%
- Bags 300 to 599: 45%
- Bags 600 to 999: 50%
- Bags 1,000 and above: 55%
Because each band is calculated separately, reaching a higher band does not change the rate already earned on earlier bags. The Payout schedule in effect at the time a Fundraiser is created is the schedule that applies to that Fundraiser for its entire duration.
Payouts are sent electronically only. We do not send checks or money orders. Payouts are made by bank transfer through our payment processor, Stripe. A Team Leader must complete Stripe's onboarding, including providing valid bank account details, before a Payout can be sent.
If a Payout is not claimed within 12 months of Fundraiser completion, we will handle the unclaimed funds as required by Nevada law.
7. Taxes
a. Taxpayer information. Before we send a Payout, our payment processor, Stripe, asks for the payee's legal name, tax identification number and whether the payee is an individual, a company, a nonprofit or a government entity. You agree that this information is complete and correct, and to update it with Stripe if it changes. We do not ask for or store Social Security numbers ourselves.
b. Tax forms. A Payout to an organization with its own federal tax ID (EIN) is paid to that organization. A Payout made to a Team Leader under the Organizer Promise is intended for the group, not as compensation to the Team Leader, so we do not usually issue a tax form for it. Where the law requires it, for example when a Payout is kept for personal use or is paid to an organization that is not tax-exempt, we will issue an IRS Form 1099.
c. Incorrect information and backup withholding. If the IRS tells us that a payee's name and tax identification number do not match its records, we will ask for corrected information. If we do not receive it, the law may require us to withhold part of a Payout and send it to the IRS (backup withholding). A Payout may be reduced by any amount we are required to withhold.
d. Sales tax. Sales tax is added to a purchase only where the law requires it.
e. Purchases are not donations. A purchase is the purchase of popcorn from GStrasse LLC. It is not a charitable donation and is not tax-deductible.
f. Your own taxes. You are responsible for your own tax obligations connected with a Payout. GStrasse LLC does not give tax advice.
8. Payments and Refunds
All purchases are processed through our third-party payment partner. Stevie G's does not store your credit card information.
All sales are final. If your order arrives damaged or incorrect, please contact us at team@steviegspopcorn.com within 7 days of delivery.
